رد تقاضاي استيناف مرد ايراني

دادگاه عالي ايران, تقاضاي استيناف جعفر كاظمي بر عليه حكم اعدامش را رد كرد. اين حكم به خاطر اتهام شركت در تظاهرات ضد حكومتي و داشتن رابطه با يك سازمان ممنوعه بوده است. حكم وي ممكن است هر لحظه به اجرا در بيايد. شش تن ديگر به خاطر اتهام داشتن رابطه با همين سازمان گفته ميشود كه زير اعدام هستند.

جعفر كاظمي در تاريخ 18 سپتامبر 2009 دستگير و بازجويي شد و احتمالا ماه هاست در زندان اوين در تهران زير شكنجه است.اتهامات وي  شركت در تظاهراتي است كه در پي اعلام نتيجه انتخابات بحث انگيز رياست جمهوري در ايران در ژوئن 2009 بوقوع پيوست و داشتن رابطه با گروه آپوزيسيون ممنوعه سازمان مجاهدين خلق ايران ميباشد, وي متهم به ارتكاب هيچگونه عمل خشونت باري نشده است,

او به اتهام محاربه و همچنين تبليغ بر عليه نظام محكوم شده است. در 26 آوريل او از حكم اعدامش كه توسط دادگاه استيناف تاييد شده بود مطلع گرديد. يك تقاضاي استيناف ديگر در اواخر ژوئيه رد شده است.

عفو بين الملل از حكم اعدام 6 تن ديگر در ايران به خاطر اتهام داشتن رابطه با سازمان مجاهدين خلق ايران مطلع است. محمد علي حاج آقايي, علي صارمي, عبدالرضا قنبري, احمد دانشپور مقدم و محسن دانشپور مقدم, احتمالا در كيسي مانند جعفر كاظمي همچنين گفته ميشود به اتهام محاربه محكوم شده اند, اطلاعات دريافت شده در 4 اوت بيانگر اين است كه يك نفر ديگر به نام جعفر لاري كه يك تاجر بازار تهران ميباشد نيز به خاطر محاربه به مرگ, بدون امكان استيناف محكوم شده است. او نيز در زندان اوين جاييكه طبق گزارشات تحت شكنجه براي اعتراف اجباري قرارگرفته نگه داري ميشود.

APPEAL for iranian man rejected

Iran's Supreme Court has rejected Ja'far Kazemi's request to appeal against his death sentence. The sentence was imposed for his alleged participation in anti-government demonstrations and links with a banned organization. His sentence may be carried out at any time. Six other people with alleged links to the same organization are said to be under sentence of death.  

Ja’far Kazemi was arrested on 18 September 2009 and interrogated and possibly tortured for months in Evin prison in Tehran. He was accused of participating in protests which followed the disputed outcome of Iran’s presidential election in June 2009, but was not accused of committing any violent acts; and for his alleged contact with banned opposition group the People’s Mojahedin Organization of Iran (PMOI). He was sentenced to death for "enmity against God", and is also believed to have been convicted of “propaganda against the system”. On 26 April, he learned that his death sentence had been confirmed by an appeal court. A further appeal was apparently rejected in late July.

Amnesty International is aware of six other men sentenced to death in Iran for alleged links to the PMOI. Mohammad Ali Haj Aghaei ,Ali Saremi (or Sarami), Abdolreza Ghanbari, Ahmad Daneshpour Moghaddam and Mohsen Daneshpour Moghaddam were reportedly also found guilty of "enmity against God", possibly in the same case as Ja'far Kazemi. Information received on 4 August indicated that another man, Javad Lari, a merchant in the Tehran bazaar, had been sentenced to "death, without pardon" for "enmity against God". He is also held in Evin prison, where he was reportedly tortured and forced to ‘confess’.

PLEASE WRITE IMMEDIATELY in Persian, English, or your own language (Please refer to Ja’far Kazemi as "Ja’far Kazemi, son of Bahman" in your appeals, as this will help the authorities to identify him):

n      Urging the Iranian authorities not to execute Ja’far Kazemi, Javad Lari, Mohammad Ali Haj Aghaei, Ali Saremi (or Sarami), Abdolreza Ghanbari, Ahmad Daneshpour Moghaddam and Mohsen Daneshpour Moghaddam;

n      Reminding the Iranian authorities that the International Covenant on Civil and Political Rights, to which Iran is a state party, states that the death penalty can only be carried out for “the most serious crimes”, which the Human Rights Committee has clarified must be “intentional crimes with lethal or other extremely grave consequences."

n      Stating that Amnesty International recognizes the right and responsibility of governments to bring to justice, in conformity with international standards for fair trial, those suspected of criminal offences, but opposes the death penalty as the ultimate cruel, inhuman and degrading punishment.

Ja’far Kazemi is reported to have been interrogated by security forces for months, and was pressured to make a televised “confession”, which he refused to do. He was previously imprisoned for membership of the PMOI in the 1980s or 1990s. One of his sons is a PMOI member and lives in Camp Ashraf, which houses PMOI members in Iraq. On 1 August, his wife, Roudabeh visited the Judiciary’s office in order to deliver a letter. They refused to accept it and informed her that the death sentence would be carried out.

Tehran’s prosecutor announced on 15 May that the death sentences of Ja’far Kazemi, Mohammad Ali Haj Aghaei, Mohammad Ali Saremi (or Sarami), Abdolreza Ghanbari (or Qanbari) and father and son, Ahmad and Mohsen Daneshpour Moghaddam, were upheld by the Appeal Court after they were found guilty of "enmity against God" in relation to their alleged links to the PMOI. In some cases, these links may amount to no more than having contact with family members linked to the PMOI

Two women, Motahareh (Simin) Bahrami and Rayhaneh Haj Ebrahim, and one other man, Hadi Gha’emi have had their death sentences commuted to prison terms. Mohammad Amin Valian was acquitted of "enmity against God" on appeal and his sentence commuted to imprisonment and payment of a fine.

Teacher Abdolreza Ghanbari, aged 42, was arrested after the demonstrations which took place in later December 2009 marking the Ashoura religious commemorations, in which he was accused of participating. Held in section 2A of Evin Prison, which is under the control of the Revolutionary Guards, he was tried on 30 January 2010 and made a “confession” which is believed to have been made under duress.

Ali Saremi (or Sarami), aged 62, has a son in the PMOI who lives in Camp Ashraf, Iraq, whom he has visited. Ali Saremi has spent 23 years in prison for his political activities both before and after the 1979 Islamic Revolution in Iran (see http://www.amnesty.org/en/library/info/MDE13/007/2010/en).

پنج زنداني ديگر از هفده زنداني سياسي بند ۳۵۰که از روز دوشنبه گذشته دست به اعتصاب غذا زده اند ،امروز (سه شنبه ) به بهداري اوين منتقل شدند .

آنها پس از دريافت خدمات اوليه پزشکي دوباره به سلول هاي انفرادي منتقل شدند و به اعتصاب غذاي خود ادامه دادند.

طبق اخبار رسيده از زندان اوين به کلمه عبدالله مومني ،فعال دانشجويي ،بهمن احمدي امويي ، روزنامه نگار ، جعفراقدامي فعال مدني، ابراهيم (نادر) بابايي فعال مدني و از جانبازان جنگ ايران و عراق و کيوان صميمي ، روزنامه نگار از جمله اين زندانيان بوده اند .

پيش از اين نيز چهار زنداني ديگر به دليل وخامت حال شان به بهداري اوين منتقل شده بودند .

خانواده اين هفده زنداني از شنيدن اين اخبار بسيار نگران شده اند و خواهان رسيدگي هر چه سريع تر مسولان زندان به خواسته هاي عزيزان شان شده اند آنها همچنين از دادستان تهران مي خواهند که امکان ملاقات باآنها را براي شان فراهم آورد . (سایت كلمه – 13/5/89)

رفتار توهين‌آميز پرسنل بهداري زندان اوين با اعتصاب کنندگان

پرسنل بهداري و مسئولان زندان اوين با اعتصاب کنندگاني که در اثر ضعف جسماني به بهداري منتقل شده‌اند، رفتار نامناسب و توهين آميزي دارند.

پرسنل بهداري زندان اوين، صبح روز جاري، به جاي درمان زندانيان سياسي اعتصاب کننده در سلول‌هاي انفرادي که به بهداري زندان منتقل شده‌اند، به پرخاشگري و توهين به آن‌ها ‌پرداختند.

به گزارش خبرنگار رهانا، در حالي که تعدادي از اعتصاب کنندگان که نام آن‌ها مشخص نيست، روز جاري به بهداري زندان اوين منتقل شده بودند، پرسنل و پرستاران بهداري، فرياد مي‌زدند که: «شما يک مشت منافقيد»، «کشور را به هم ريخته‌ايد و حالا زندان را به ريخته‌ايد» و برخوردهاي نامناسب و توهين آميزي با زندانيان داشتند. يورش وحشيانه نيروهاي سرکوبگر به تجمع اعتراضي خانواده هاي زندانيان سياسي در مقابل دادستاني

بنابه گزارشات رسيده به "فعالين حقوق بشر و دمکراسي در ايران" نيروهاي سرکوبگر به اعتراضات خانواده هاي زندانيان سياسي در مقابل دادستاني يورش بردند و عکسهاي فرزندان آنها را پاره و به خانواده وحشيانه برخورد کردند.

روز چهارشنبه 13 مرداد ماه حوالي ساعت 10:00 صبح خانواده هاي زندانيان سياسي بند 350 زندان اوين در اعتراض به انتقال عزيزانشان به سلولهاي انفرادي و وادار کردن آنها به اعتصاب غذا و ايجاد شرايط و محدوديتهاي غير انساني در مقابل دادستاني تهران که در سبزه ميدان مي باشد تجمع اعتراضي خود را برپا کردند.

از لحظات اوليه تجمع اعتراضي نيروهاي سرکوبگر ولي فقيه در اطراف دادستاني مستقر شده بودند و خانواده هاي زندانيان سياسي را تهديد به دستگيري مي کردند.وقتي که خانواده ها بر خواسته هاي حق طلبانه خود اصرار مي ورزيدند با يورش و حشيانه نيروهاي سرکوبگر مواجه شدند. نيروهاي سرکوبگر به سمت خانواده ها يورش بردند و عکسهاي عزيزانشان که در بند هستند را پاره کردند و آنها را مورد توهين واذيت وآزار قرار دادند. محکوميت رسول بداقي به شش سال حبس و پنج سال محروميت از فعاليت‌هاي اجتماعي

شعبه‌ي پانزدهم دادگاه انقلاب به رياست قاضي صلواتي، رسول بداقي، عضو هيات مديره‌ي کانون صنفي معلمان ايران را به 6 سال زندان و 5 سال محروميت از فعاليت‌هاي اجتماعي محکوم کرد.

به گزارش بامدادخبر، يک سال از اين حکم به اتهام "تبليغ عليه نظام" و 5 سال ديگر به اتهام "تباني و تجمع به قصد برهم زدن امنيت ملي" صادر شده است.

رسول بداقي از دهم شهريورماه سال گذشته در بازداشت به سر مي‌برد و از اردي بهشت‌ماه سال جاري به زندان رجايي‌شهر در کرج تبعيد شده است. (بامدادخبر - 12/5/89)

محکوميت سنگين و ضد بشري 2 بازاري زنداني بازار تهران

روز يکشنبه 10 مرداد ماه بازاريان زنداني جواد لاري و محسن دگمه چي توسط صلواتي رئيس دادگاه فرمايشي شعبه 15 دادگاه انقلاب به احکام سنگين و ضد بشري محکوم شدند. آقاي جواد لاري به اعدام و آقاي محسن دگمه چي به 10 سال زندان و تبعيد به زندان گوهردشت کرج محکوم شد..

بازاري زنداني محسن دکمه چي 50 ساله از بازاريان شناخته شده و خوش نام بازار تهران روز يکشنبه 10 مرداد ماه به دادگاه انقلاب برده شد و حکم سنگين و غير انساني 10 سال زندان و تبعيد به زندان گوهردشت کرج محکوم شد. آقاي دکمه چي به اتهام کمک مالي به خانواده هاي زندانيان سياسي و حضور فرزندش در قرارگاه اشرف در عراق مورد محاکمه قرار گرفت...

بازاري ديگري که از آذرماه همچنان در بند 209 زندان اوين در بازداشت بسر مي برد محمد بنازاده امير خيزي نام دارد. او در شرايط غير انساني و در بلاتکليفي در اين بند بسر مي برد.

لازم به ياد آوري است که آقاي دکمه چي و آقاي جواد لاري از زندانيان سياسي دهۀ 1360 مي باشند و هر کدام از آنها چندين سال در زندان بسر بردند و مورد شکنجه هاي غير انساني قرار گرفتند. (فعالين حقوق بشر ودمكراسي در ايران – 13/5/89)

نصور نقي پور از محل کار خود اخراج شد

نصور نقي پور روزنامه نگار و فعال حقوق بشر از محل کار خود اخراج شد.

بنا به اطلاع گزارشگران هرانا، وي که کارگر دو شيفتي کارخانه کاشي و سراميک البرز در قزوين بود پس از دستگيري و تحمل بيش از 110 روز حبس به دليل فعاليت هاي حقوق بشري، توسط مسئولان کارخانه از کار اخراج شده است.

مسئولان کاشي و سراميک البرز دليل خاصي براي اين اقدام خود عنوان نکرده اند. (هرانا – 13/5/89)

محکوميت اسماعيل صحابه به چهار سال و نيم حبس تعزيري

اسماعيل صحابه،‌ در دادگاهي به رياست قاضي صلواتي، به جرم نقش داشتن در برگزاري دعاي کميل، به چهار سال و نيم حبس تعزيري محکوم شد.

در جلسه دادگاه صحابه، قاضي صلواتي در دادگاه حضور نداشته و بدون شنيدن دفاعيات اسماعيل صحابه اقدام به صدور حکم کرده است.

به گزارش نداي سبز آزادي، اسماعيل صحابه عضو جبهه مشارکت پيش از اين در مراسم دعاي کميل دستگير و دو ماه زنداني شد که با قيد وثيقه تا برگزاري دادگاه به طور موقت آزاد بود. (رهانا – 13/5/89)

بازداشت بهنام متعارفي، از شهروندان بهايي ساکن سمنان

بهنام متعارفي شهروند بهايي ساكن سمنان، براي گذراندن دوران محکوميت خود بازداشت و به زندان سمنان منتقل شد.

بنا به اطلاع گزارشگران هرانا، وي سال گذشته مدتي بازداشت و سپس به اتهام "تبليغ عليه نظام و عضويت در تشكيلات بهائيت" محاكمه و به 18 ماه حبس تعزيري محكوم شده بود. (هرانا – 13/5/89)

صدور حکم ١۵ سال حبس براي فرح واضحام از متهمان حوادث روز عاشورا

فرح واضحام از متهمين روز عاشورا از سوي شعبه ١۵ دادگاه انقلاب اسلامي به اتهام محاربه به ١۵ سال حبس محکوم شد.

فرح واضحام که هم اکنون در بند عمومي زندان اوين به سر مي‌برد حدود هفت ماه در «بازداشت موقت» بوده است. واضحام دو روز بعد از حوادث روز عاشورا در تاريخ ١٠ دي ماه ١٣٨٨ در منزل خود بازداشت شده بود.

به گزارش خبرنگار رهانا، اين حکم که از سوي قاضي صلواتي در شعبه ١۵ دادگاه انقلاب صادر شده است، امروز به وي ابلاغ شده است.

اتهام فرح واضحام شرکت در اعتراض‌هاي خياباني و «محاربه از طريق همکاري با سازمان مجاهدين» اعلام شده است. وي سال‌ها خارج از کشور زندگي مي‌کرده است و به خاطر دختر ١٩ ساله‌اش که به سرطان مبتلا است و شيمي درماني مي‌شود به ايران بازگشته است. (رهانا – 13/5/89)

Five other hunger striking political prisoners from the 17 that have gone on hunger strikes in cellblock 350 were taken to the Evin Prison infirmary today. They started their hunger strike last Monday.

They were returned to solitary after receiving first aid care and continued their hunger strikes.

According to the latest reports from Evin Prison, student activist Abdollah Momeni, journalist Bahman Amouyi, civil rights activist Jafar Eqdami, civil rights activist Ibrahim Babayi who has also been injured in the Iran Iraq war and journalist Keivan Samimi were among these prisoners taken to the infirmary.

Before this, four other prisoners were taken to the infirmary after going into critical condition.

The families of these 17 prisoners became very concerned after hearing this news and requested that prison authorities see to their cases as soon as possible. They also asked the Tehran Prosecutor to provide facilities for them to visit their loved ones. (Kalameh Website – Aug. 4, 2010)

Political prisoner hunger strikers treated inhumanely and insulted in prison infirmary

The personnel of the Evin Prison infirmary and prison officials treat political prisoner hunger strikers who have been taken to the infirmary because of weak physical conditions unsuitably and insult them.

Instead of giving them treatment, the infirmary personnel started cursing and insulting these political prisoners.

The personnel and nurses in the infirmary shouted at the hunger strikers that ‘you are a bunch of hypocrites’, ‘you have disrupted the country and now are disrupting the prison’ and treated them unsuitably. (Committee of Human Rights Reporters – Aug. 4, 2010)

According to reports from Iran, security forces attacked families of political prisoners gathered outside the Prosecutor’s Office, ripped up pictures of their jailed loved ones and treated them with violence.

On Wednesday, August 4, at about 10 am, the families of political prisoners in cellblock 350 in Evin Prison gathered outside the Tehran Prosecutor’s Office in protest to the transfer of their loved ones to solitary cells which forced them to go on hunger strikes.

From the very beginning of the gathering, security forces were stationed around the Prosecutor’s Office and threatened the families of political prisoners with arrest. When these families insisted on their rights, they were attacked by security forces. Security forces ripped up pictures of political prisoners held by their families and insulted and verbally abused these families. (Human Rights and Democracy Activists in Iran – Aug. 4, 2010)

Academic activist sentenced to 6 years of prison and a 5 year ban on social activities

The 15^th branch of the Revolutionary Court headed by Judge Salavati sentenced Rasoul Bodaqi, a member of the managing board of the Teacher Center of Iran to six years of prison and a five year ban on social activities.

He was sentenced to one year of prison for ‘propagating against the government’ and five years of prison for ‘conspiring and assembling with the intention of disrupting national security’.

Rasoul Bodaqi was arrested on September 1, 2009 and was transferred to Rajayi Shahr (Gohardasht) Prison in Karaj in April. (Bamdad Khabar – Aug. 3, 2010)

Iran sentences two Bazaar merchants to heavy sentences

On Sunday August 1, political prisoner Javad Lari and Mohsen Dogmehchi were sentenced to harsh, inhumane sentences by the head of the 15^th branch of the Revolutionary Court, Salavati. Javad Lari was sentenced to death while Mohsen Dogmehchi was sentenced to 10 years of prison to be served in Gohardasht Prison in Karaj.

Dogmehchi is a 50-year-old well known Tehran Bazaar merchant who was taken to court from prison on Sunday August 1. He was tried on charges of giving financial aid to the families of political prisoners and the presence of his daughter in Camp Ashraf in Iraq…

Another Bazaar merchant who is still detained in cellblock 209 since December 2009 is Mohammad Banazadeh Amir Khizi. He is kept under inhumane conditions and is in an undetermined state.

Notably, Mr. Dogmehchi and Mr. Javad Lari were both political prisoners in the 80’s who were jailed for a number of years under torture. (Human Rights and Democracy Activists in Iran – Aug. 4, 2010)

Human rights activist expelled from job

Human rights activist and journalist Nasour Taqipour was fired from his job. According to reports, he worked two shifts in the Alborz Tile and Ceramics Factory in Qazvin and after being arrested and spending 110 days in detention for his human rights activities, he was fired from the factory.

The managers of the Alborz Tile and Ceramics Factory did not state the reason for this measure. (Human Rights Activists in Iran – Aug. 4, 2010)

Political activist sentenced to more than 4 years of prison for holding prayer ceremony

Ismail Sahabeh was sentenced to four and a half years of prison by Judge Salavati for playing a part in holding a Kamil prayer session (which was held to pray for the release of political prisoners after the elections).

Judge Salavati was not present in Sahabeh’s court session and issued this prison sentence without hearing his defense.

Sahabeh is a member of the Participation Front who was arrested in the Kamil prayer session and was jailed for two months before being temporarily released on bail. (Committee of Human Rights Reporters – Aug. 4, 2010)

Iran arrests another Baha’i resident

Behnam Mote-arefi, a Baha’i resident of Semnan was transferred to Semnan Prison to serve his prison term.

He was jailed for some time last year on charges of ‘propagating against the government and being a member of a Baha’i organization’ and was sentenced to 18 months of prison. (Human Rights Activists in Iran – Aug. 4, 2010)

Female political prisoner sentenced to 15 years of prison

Farah Vazham who was arrested for (participating in) the Ashura protests was sentenced to 15 years of prison on charges of being a mohareb (waging war with God) by the 15^th branch of the Revolutionary Court.

Vazham is currently in the public cellblock in Evin Prison and has been in ‘temporary detention’ for seven months. She was arrested two days after Ashura in her home on December 29.

This sentence which was issued by Judge Salavati was announced to her today.

She was charged with participating in the street protests and ‘waging war with God by cooperating with the People’s Mojahedin Organization of Iran’. She had lived outside of Iran for years and only came back to Iran to be at the side of her 19 year old daughter who has cancer and is receiving chemotherapy.
